A hearing before the Lafayette Municipal Court has been granted for Defendant Walker’s Motion to Dismiss at 1 p.m. (MST), Friday, March 5, 2010 at the Lafayette Municipal Court, 451 North 111th Street, Lafayette, Colorado 80026. Defendant Walker’s motion to dismiss charges seeks to declare the City of Lafayette’s ordinance on vicious dogs unconstitutional as applied under Colorado law due to the conflict with the state statute.

DENVER, Colorado (November 12, 2009) – In a settlement approved by Federal Chief Judge Wiley Y. Daniel, the City of Brighton will be required to train and equip its police officers on the proper and safe handling of animals encountered during the course of police actions. This settlement is precedent setting in that it is the first in the United States to require a municipality to ensure all police officers are trained and equipped to protect animals as it would its citizens.
Lawyers for The Animal Law Center (ALC) have successfully called into question the City of Denver’s ability to accurately enforce its own ban on pit bulls. This achievement was the result of a recent ruling which determined that city officials had misidentified a boxer-mix as a pit bull. The case revealed the city’s reliance upon inadequately trained personnel and faulty evidence to identify breeds banned under its own ordinance 855. The implication is that hundreds of misidentified dogs may have been unnecessarily euthanized in the years since the ban has been in force.
